📰 AIBA Urges PM Modi to Provide Lifetime Residential Facilities to Former CJIs, PMs, and Speakers

The All India Bar Association (AIBA), under the leadership of President Sr. Advocate Dr. Adish C. Aggarwala, has formally written to Prime Minister Narendra Modi, requesting the enactment of legislation to provide lifetime residential accommodation to former Chief Justices of India (CJIs), former Prime Ministers, and Speakers of the Lok Sabha.
🧾 Reason for the Appeal
The representation follows reports of difficulties faced by Hon’ble Dr. Justice D.Y. Chandrachud, the former Chief Justice of India, in securing post-retirement accommodation in Delhi. Despite being eligible under the Supreme Court Judges (Amendment) Rules, 2022, which guarantees rent-free Type-VII accommodation in Delhi for six months post-retirement, Justice Chandrachud was unable to find alternate housing even after this tenure.
🏠 Delay Impacted Successor CJI’s Residence
Due to these difficulties, Justice Chandrachud had to retain the official Chief Justice residence at 5, Krishna Menon Marg, which inadvertently delayed the occupation of the bungalow by his successor, Hon’ble Mr. Justice Sanjiv Khanna, the current Chief Justice of India. Even after an extended stay, reports suggest that Justice Chandrachud struggled to find suitable private housing in the national capital.
⚖️ Supreme Court Registry Intervention
The situation became so pressing that the Supreme Court Registry had to approach the Ministry of Housing and Urban Affairs, requesting formal steps for vacating the bungalow. As per the letter, even after 47 days of vacancy, the present CJI Justice B.R. Gavai has been unable to move into the official residence due to these cascading delays.
📢 AIBA’s Legislative Proposal
The AIBA has strongly recommended that Parliament pass legislation guaranteeing life-long government housing to:
- Former Chief Justices of India
- Former Prime Ministers of India
- Former Speakers of the Lok Sabha
Such a step, according to the Bar Association, is necessary to preserve the dignity of the highest public offices and ensure that such constitutional dignitaries do not face hardships post-retirement.
